Civil Rights — Excessive force – Qualified immunity 

Where a defendant police officer has moved for summary judgment in an excessive force suit over the use of lethal force, the motion should be denied, as the issue of whether the defendant shot a suspect when he had turned away and was no longer a threat is a question of material fact for the jury’s determination.
